Please note day and time restrictions for certain packages: Weekend Private Parties are ONLY on Sat/Sun Weekday Birthday Bash is ONLY T-F from 4pm to 6pm House and Block Parties (non-Private parties)  are Sat/Sun at 10am PAYMENT: At checkout, you can choose to pay the deposit (50%) or the full amount (called Drop-In).  If you opt for the deposit, the balance can be paid in your app at any time but must be paid one week before your party date.   Private Block Party Our Deluxe Party Package with space for more friends. PARTY SPACE RENTAL AGREEMENT & REGULATIONS **A copy of this agreement will be emailed to you upon booking** This agreement dated the day of the deposit received, between MY VILLAGE PLAYHOUSE, LLC (“PARTY SPACE NAME”), a Massachusetts Limited Liability Company and _CUSTOMER NAME _ (“ Party Renter”) for the rental of PARTY SPACE located at 270 New State Highway Raynham (“Party Space”).  By executing this Agreement, all Party Renters and their guests assent and agree to comply with all of the following policies and procedures of MY VILLAGE PLAYHOUSE, as set forth herein. The policies, procedures and this agreement may be amended from time to time at MY VILLAGE PLAYHOUSE’s sole discretion and with no notice to Party Renter. Deposit and Overtime: Any rental of space from MY VILLAGE PLAYHOUSE for a party must be secured with a non refundable security deposit of HALF THE COST OF THE PARTY and ANY ADD ONS. Only upon payment of this non-refundable security deposit shall MY VILLAGE PLAYHOUSE securely hold the requested space for the private party ROOM. The non-refundable security deposit will be applied to the total rental balance. The balance amount due and owing must be paid in full at least 7 days before the date of the party unless specified differently by My Village Playhouse.  Any changes made within 7 days of the party must be paid in full at time of change.   If the party room and play area is not vacated by the designated end time, the Party Renter agrees to pay $10 per minute over time.   The Party Host may arrive 15 minutes prior to the start of the designated party time for any last minute set up of additional items.   The Party Renter and all guests must completely vacate the premises within 15 minutes of the contracted party end time. If you’d like a longer party, please make your request prior to your event (restrictions and additional fees apply) Please note that not all party packages are Private; please carefully review your package details.  Non-Private parties allow for other patrons to enjoy the play space while birthday parties are happening (i.e., open to the public).  Play Area Policies for Parties We will be actively enforcing our normal safety rules and policies during parties Our infant area is designed for guests 24 months and younger. If any older child (including an infant’s sibling) enters this area, MY VILLAGE PLAYHOUSE reserves the right to ask the older child to leave the area immediately.   Our play area is designed for children aged 5 and under. Adults and children older than 5 are more than welcome to play with the play-area aged children during the event.  However, if any child or adult misuses equipment, plays too roughly, or is deemed by MY VILLAGE PLAYHOUSE in any other way inappropriate they will be asked to leave the play area.   Parents are required to keep a watchful eye on their children at all times.   Food and Add-Ons: Food or add-ons provided for the party must be pre-arranged with MY VILLAGE PLAYSPACE at least seven (7) business days prior to the private party. Any changes made after this deadline must be pre-approved. Substitutions: MY VILLAGE PLAYHOUSE, may, at its sole discretion, make reasonable substitutions. Pricing may be adjusted for market price variations that are beyond the reasonable control of MY VILLAGE PLAYHOUSE.   Outside food including cupcakes, baked goods, snacks, and appetizers are welcome for our birthday parties.  No outside beverages are permitted.  Only bottled water and beverages purchased from the MVP cafe are allowed on the play floor (adults only; children are not permitted to eat or drink in the play space).  Open flame (including sternos) and equipment that require an outlet are not permitted.  CUPCAKES/CAKE  Party Hosts will need to provide their own cupcakes.  Cupcakes are preferred over cake as they are significantly faster to serve and make much less of a mess.  Party Hosts may opt to bring a cake instead, but will incur a $25 cake cutting/cleaning fee.  Party Hosts are not permitted to cut their own cake.  If desired, you MAY bring a cake for display/candle blowing and take it home un-cut without incurring the cake cutting fee.  Outside food may be served at any time during the event. However, your party assistant will help facilitate the pizza and drinks for the children, cupcakes (or cake cutting) and singing Happy Birthday.  No alcoholic beverages of any kind are allowed to be consumed on premises or in the parking lot. Anyone found to have alcoholic beverages will be asked to leave My Village Playhouse.  Additional Decoration: Nothing may be hung on the walls or ceiling without the express, written permission of MY VILLAGE PLAYHOUSE. Any client who adheres tape to the walls will be assessed a fine in the amount of $250 for damages, regardless of whether damage is immediately visible. Helium balloons must be tied down either to a balloon weight or chairs. We do not allow piñatas, glitter, confetti, face paint or bubbles.  All My Village Playhouse decorations are the sole property of My Village Playhouse. Exclusions may apply such as a party favors, some balloons, gift bags, etc.  Your party assistant will clarify items that children are allowed to take.  Intentional damage or theft of party decor items may result in additional replacement charges.   Damage & Cleaning: Any excessive damage done to the MY VILLAGE PLAYHOUSE premises or to the Party Space or other MY VILLAGE PLAYHOUSE  property shall be billed to Party Renter for either replacement or repair. In the occurrence of an additional mess – as determined by the MY VILLAGE PLAYHOUSE management or staff – created or done by the Party Renter or any of its party guests (children and adults included) resulting in extra cleaning of the Party Space, MY VILLAGE PLAYHOUSE premises or other MY VILLAGE PLAYHOUSE property shall result in  Party Renter to be charged an additional $250.00 non refundable cleaning fee. Any additional damage to the MY VILLAGE PLAYHOUSE premises, the Party Space or other MY VILLAGE PLAYHOUSE contents or property created or done by the Party Renter or any of its party guests (children and adults included) shall be charged to the  Party Renter accordingly. MY VILLAGE PLAYHOUSE cleans and sanitizes its toys, property, Party Space, premises and other property (including bathrooms) on a consistent basis. Party Renter and all party guests must ensure that they dispose of all waste materials such as diapers, paper towels and trash in the correct receptacles provided by MY VILLAGE PLAYHOUSE.    Gratuity:Gratuity for your Party Attendant is not required but is appreciated and left up to the discretion of the Party Renter. Tips can be left in cash, added to a final bill or via Venmo.  Open Bar/Cafe will automatically incur a 20% service charge at checkout. Socks: MY VILLAGE PLAYSPACE is a “no shoes, socks required” play space. Socks ARE required in the play space at all times. Both adults and children are required to wear socks as part of public health code. This is necessary for the health and safety of the children. The Party Renter is responsible for informing guests they must bring socks with them when they enter MY VILLAGE PLAYSPACE. If a guest does not have socks, MY VILLAGE PLAYSPACE can sell them a pair for $4.00 or run a tab for socks that will be charged to the Party Renter at the completion of the party.  Personal Property: MY VILLAGE PLAYSPACE, its agents and employees are not responsible for the Party Renter or any of its Party Guests personal property. It is the sole responsibility of each person entering into the facility to be responsible for all possessions and belongings unless pre-arranged with MY VILLAGE PLAYHOUSE and/or its staff. Under no circumstances shall MY VILLAGE PLAYSPACE, its agents or employees, take responsibility for any lost, stolen, missing or damaged personal property or otherwise. Safety:Party Renter and the parents of the party guests (invited or otherwise) are completely responsible for the well-being and behavior of their minor child while on the MY VILLAGE PLAYSPACE premises, the Party Space or other MY VILLAGE PLAYSPACE property. Conduct: MY VILLAGE PLAYSPACE reserves the right to ask any child or adult during the Private Party found to be destructive and/or abusive to any other guests (whether party guests or not), or MY VILLAGE PLAYHOUSE staff or employees to immediately leave MY VILLAGE PLAYSPACE property. Indemnification: The Party Renter agrees to hold harmless and indemnify MY VILLAGE PLAYHOUSE, its officers, directors, employees, and agents (collectively, the “indemnified Parties”), from and against any and all losses, costs, expenses, including but not limited to, reasonable attorneys' fees, claims, actions, demands, damages incurred by or asserted against the indemnified Parties by reason of the acts, omissions or negligence of the Client, its guests, employees, agents or independent contractors, arising out of or in any way connected with the Party Renter’s event (Birthday Party or similar), except when directly caused by the gross negligence or willful misconduct of the Indemnified Parties. Cancellations/Rescheduling: DEPOSITS ARE NON-REFUNDABLE.   MY VILLAGE PLAYHOUSE will work with Party Renter to reschedule the event within 2 months of the original date should the Party Renter need to reschedule the party due to an emergency (significant illness of the birthday child or sibling, party host and/or significant other, a death in the immediate family, or significant inclement weather) without incurring an additional fee.  MY VILLAGE PLAYHOUSE reserves the right to ask for documentation for illness or death in the family.  If a party is canceled or rescheduled within 7 days of the original date, the Party Renter may incur the cost of any additional food add-ons or special appearances that had been scheduled.  In addition, Party Renter also forfeits any future benefits from the non refundable security deposit. Cancellations due to inclement weather are determined by MY VILLAGE PLAYHOUSE, not by the Party Host.    Default: Failure by the Party Renter to timely pay MY VILLAGE PLACEHOUSE all amounts due shall constitute a default by the Party Renter. Upon a default by the Party Renter, MY VILLAGE PLAYHOUSE, at its sole discretion, may (I) terminate this contract and retain all amounts paid to MY VILLAGE PLAYHOUSE as liquidated damages, or (II) enforce the terms of this contract through any and all remedies that it has as defined in this contract. In no event of default shall MY VILLAGE PLAYHOUSE be liable to the Party Renter for any amount in excess of amounts paid to MY VILLAGE PLAYHOUSE. Said payment constitutes the Party Renter’s sole and exclusive remedy and the Party Renter hereby relinquishes any and all causes of action, which the Client otherwise have in law or in equity as defined in this Contract.  Applicable Law and Construction. The laws of the State of Massachusetts shall govern the validity, performance and enforcement of this Lease.  Arbitration: By executing this agreement, MY VILLAGE PLAYHOUSE and the Party Renter agree that any dispute or claim arising under or with respect to this Agreement will be resolved by Arbitration in Massachusetts before an arbitrator chosen by agreement of the Parties. Each party shall equally bear any costs associated with arbitration. The award shall be final and binding upon the parties. Any award may be entered as a judgment or order in any court of competent jurisdiction. Force Majeure. Neither My VILLAGE PLAYHOUSE nor Party Renter shall be liable or responsible for any delays or cancellations of the Private Party due to strikes, lockouts, casualties, acts of God, war, governmental regulation or control or other causes beyond the reasonable control of the My VILLAGE PLAYHOUSE or Party Renter. These policies shall be governed by and construed in accordance with the laws of the State of Massachusetts. The undersigned has read and understands the aforementioned Party Space Rental Agreement and Regulations and agrees to abide by and be bound by such agreements and regulations.
